Terms and Conditions

Welcome to MyQare. Please read these Terms and Conditions ("Terms") carefully before using the MyQare mobile application ("Application") and the services offered by MyQare ("Services"). By downloading, registering, or using this Application, you agree to be bound by these Terms. If you do not agree, you are not permitted to use this Application.

1. Definitions

  • "MyQare", "We", "Us", or "the Company" refers to Unimedia Digital Sdn Bhd, the owner and operator of the MyQare application.

  • "User" refers to any individual who registers on the Application to find and book care services.

  • "Qarer" refers to the independent service providers (caregivers/nannies) who offer their services through the Application.

  • "Care Services" refers to childcare, elderly care, special needs care, or companionship services provided by a Qarer to a User.

2. Nature of Services & Gig Economy

  • 2.1 Intermediary Platform: MyQare is a technology platform that connects Users with Qarers. MyQare DOES NOT directly provide Care Services.

  • 2.2 Independent Contractors: Qarers are independent contractors (gig workers) and ARE NOT employees, agents, representatives, or partners of MyQare. MyQare does not control the manner, methods, or timing of how Qarers perform their duties, subject to compliance with platform standards.

  • 2.3 Release of Liability: Any service contract is exclusively between the User and the Qarer. MyQare is not responsible or liable for any actions, negligence, or misconduct committed by a Qarer or a User.

 

3. Registration & Safe-Qare Protocol

  • 3.1 Accuracy of Information: Users and Qarers must provide accurate, complete, and up-to-date information during registration, including National Registration Identity Card (NRIC/Passport) details.

  • 3.2 Safe-Qare Screening: All Qarers are required to undergo a background screening process and training modules under the Safe-Qare framework (co-developed with UTM experts). However, MyQare does not provide an absolute guarantee regarding a Qarer's conduct. Users are advised to exercise due diligence and judgment (by reviewing profiles and ratings) before making a booking.

  • 3.3 Account Confidentiality: You are solely responsible for maintaining the confidentiality of your account credentials and password. You must notify MyQare immediately of any unauthorized use of your account.

 

4. Bookings & Service Execution

  • 4.1 Booking Process: Bookings can be made on an hourly, daily, or monthly rate as displayed in the Application. A booking is only confirmed once it is accepted by the Qarer.

  • 4.2 Safe Environment: The User is responsible for providing a safe and non-life-threatening environment for the Qarer while Care Services are being conducted on the User's premises.

  • 4.3 Non-Circumvention (Prohibition of Outside Arrangements): Users and Qarers are STRICTLY PROHIBITED from making private arrangements or financial transactions outside the MyQare Application for services initiated through the platform. If caught, both parties' accounts will be immediately suspended and they will forfeit all eligibility for insurance coverage.

 

5. Payments, Pricing & Platform Fees

  • 5.1 Care-Economy Model: MyQare operates under a care-economy model, beginning with the offering of basic childcare services known as Childqare.

  • 5.2 Childqare Base Pricing Structure: The User agrees to the base service rates for Childqare set by the platform as follows:

    • Hourly Rate: RM 30.00

    • Daily Rate: RM 180.00 (subject to the maximum working hours per day specified within the application).

    • Monthly Rate: RM 550.00 (This package is subject to specific terms, total days, and hourly frequencies agreed upon between the User and the Qarer via an in-app contract).

  • 5.3 Platform Fee (30%): MyQare charges a 30% service/platform fee on every successfully completed booking. This additional fee is essential to cover the operational costs of the MyQare ecosystem, including but not limited to:

    • Micro-insurance protection premiums by Senang.io for every care session.

    • Maintenance of the Safe-Qare background screening and training system.

    • Third-party payment gateway transaction fees (Razorpay).

  • 5.4 Total Payment Calculation: The final amount to be paid by the User during checkout (payment cart) will display the Base Service Rate plus the 30% Platform Fee. Users are required to make full payment through the Application before a booking is confirmed.

  • 5.5 Qarer Payout Transparency: Qarers acknowledge and agree that the earnings credited into their App Wallet are based on the Base Rate, after deducting any commission or the 30% Platform Fee (in accordance with the revenue-sharing structure agreed upon during Qarer registration).

  • 5.6 Prohibition of External Transactions: Any attempt by a User or Qarer to settle transactions via cash or direct bank transfers (outside of MyQare's Razorpay system) to avoid the 30% Platform Fee constitutes a severe breach of terms. It will result in the immediate cancellation of Senang.io insurance coverage and the permanent suspension of both parties' accounts.

 

6. Insurance Protection (Via Senang.io)

  • 6.1 Care Service sessions booked and paid for legitimately through the Application are protected under a micro-insurance policy provided by our partner, Senang.io.

  • 6.2 This coverage is ONLY ACTIVE during the scheduled booking duration within the Application (from the moment the "Start" button is pressed until the "End" button is pressed).

  • 6.3 Any claims regarding accidents, injuries, or property damage are entirely subject to the assessments, terms, and coverage limits stipulated by Senang.io. MyQare assumes no direct liability for the approval of insurance claims.

 

7. Cancellations & Refunds

  • 7.1 Cancellation by the User:

    • More than 24 hours before the booking start time: Full refund (100%).

    • Between 12 to 24 hours before the start time: 50% refund.

    • Less than 12 hours notice: No refund will be provided (0%).

  • 7.2 Cancellation by the Qarer: If a Qarer cancels a confirmed booking, MyQare will make reasonable efforts to find a replacement Qarer. If a replacement cannot be found, the User will receive a 100% refund. Qarers who frequently cancel bookings will face penalties or profile suspension under platform SOPs.

  • 7.3 Refund Processing: All approved refunds will be processed back to the user's original payment method via Razorpay within 3 to 7 working days.

 

8. Limitation of Liability

  • 8.1 To the maximum extent permitted by Malaysian law, MyQare shall not be liable for any direct, indirect, punitive, or consequential damages, or personal injury arising from the use of the Services or any interactions between the User and the Qarer.

  • 8.2 MyQare's maximum aggregate liability for any claims relating to the use of this Application shall not exceed the total service fees paid to the platform for the specific booking under dispute.

 

9. Privacy & Personal Data

Your personal information is handled in accordance with the MyQare Privacy Policy, which complies with the Personal Data Protection Act (PDPA) 2010. Your data is only shared with authorized third parties, such as Senang.io, Razorpay, and the Safe-Qare background check system, strictly for service delivery purposes.

 

10. Termination

MyQare reserves the right to suspend or terminate your account at any time, with or without notice, if we find you in violation of any provision within these Terms, including receiving consistently poor reviews/ratings that compromise the safety and quality standards of the Safe-Qare community.

 

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising shall be settled under the exclusive jurisdiction of the courts of Malaysia.
